The Family and Medical Leave Act (FMLA) "entitles eligible employees to take up to 12 workweeks of unpaid, job-protected leave in a 12-month period for specified family and medical reasons."

An employee can take FMLA leave for the following reasons:

  • The birth of a child of the employee
  • The placement of an adopted or foster child with the employee
  • Care of an immediate family member with a serious health condition
  • A serious health condition on the part of the employee
  • Qualifying exigencies due to an immediate family member being on active military duty or being called to duty as a member of the National Guard or Reserves in support of a contingency operation

The act also requires that once the leave is over, an employee be allowed to return to his or her former position or a position equivalent in duties, pay and benefits.
